General Terms and Conditions (GTC)

1. Subject of the Agreement

These General Terms and Conditions of Business, Sale and Delivery govern the contractual relationship between

(hereinafter referred to as "the Company")

and the purchaser of goods and services of the Company.


2. Scope and Applicability

2.1 These GTC regulate the rights and obligations between the Company and its customers.

2.2 They apply to all business relationships between the Company and its customers, in particular for the delivery of products and the provision of services, unless otherwise agreed in writing.

2.3 The customer’s own terms and conditions shall not apply unless expressly accepted in writing by the Company and provided they do not conflict with these GTC.


3. Conclusion of Contract / Communication

3.1 The customer’s order constitutes an offer to conclude a contract, which is accepted by the Company upon dispatch of the ordered goods.

3.2 The Company reserves the right not to accept an order.

3.3 Communication is generally conducted via email. The customer is responsible for providing a valid email address.

3.4 All prices are quoted net in Swiss Francs (CHF) ex warehouse Rombach.

3.5 Additional costs such as payment fees, VAT and shipping costs are shown separately.

3.6 The prices valid at the time of order confirmation apply.


4. Delivery Conditions

4.1 Unless otherwise agreed, delivery is made from our warehouse in 5022 Rombach to the shipping address specified by the customer.

4.2 Delivery time is approximately 14 working days unless otherwise stated.

4.3 No claims for damages may be asserted against the Company due to delivery delays.

4.4 Shipping costs are displayed at checkout before completing the order.

4.5 If the customer is in default of payment from previous deliveries, the Company reserves the right to withhold further deliveries until all outstanding amounts have been settled.

4.6 Partial deliveries are permitted where reasonable. Delivery periods begin upon receipt of the final partial delivery.

4.7 Delivery is subject to product availability. If a product is unavailable at the time of ordering, the customer will be informed of the expected delivery date. Once available, shipment will occur without further notice unless the order has been cancelled.


5. Returns

5.1 Orders may be returned within 10 days of receipt, unworn and in original packaging, to:

5.2 Return shipping costs are borne by the customer.

5.3 To be accepted, returns must include original packaging, original labels, no signs of wear, and an information of the return from the costumer in advance.


6. Transfer of Risk, Transport and Insurance

6.1 The Company delivers exclusively to valid postal addresses in Switzerland, Germany, France, Italy, Netherlands, Spain and Austria. Some remote areas of Italy and Spain are excluded.

6.2 Orders from private customers cannot be collected and are shipped by parcel service only.

6.3 If the customer collects the goods, risk transfers upon handover.

6.4 If goods are shipped, risk transfers upon handover to the transport company or the costumer.

6.5 Visible defects, including transport damage, must be reported in writing within 3 days of receipt.

6.6 All packaging materials must be retained until the case is resolved.


7. Payment Terms

7.1 Payment methods valid in Switzerland apply.

7.2 Available payment methods are displayed in the online shop.

7.3 All payments are due immediately without deduction.

7.4 Invoices must be paid in full. Offsetting undisputed or legally established claims remains permitted.

7.5 In case of late payment, the Company may charge a reminder fee of CHF 20 and default interest of 7% from the first reminder.


8. Retention of Title

8.1 Goods remain the property of the Company until full payment is received.

8.2 The customer must maintain the goods in resaleable condition until ownership transfers.

8.3 The Company may register the retention of title at the customer’s place of residence.


9. Defects

9.1 The customer must inspect goods for completeness and visible defects immediately, at the latest within 3 days. Otherwise, delivery is deemed accepted.


10. Warranty

10.1 Private customers are entitled to warranty claims within the scope of applicable law.

10.2 Warranty claims are excluded for commercial customers.

10.3 Manufacturer warranties apply within their respective scope.

10.4 The customer bears shipping costs to the Company; return shipping costs are borne by the costumer.

10.5 Defects will be remedied at the Company’s discretion through replacement, repair, or credit at current value.

10.6 If inspection reveals that damage was caused by the customer, processing fees may be charged.

10.7 Liability for indirect or consequential damages is excluded within statutory limits.

10.8 For private customers, products showing warranty-covered damage within 30 days from invoice date will be replaced with new goods.


11. Liability

11.1 Unlimited liability applies for intent, gross negligence, product liability, and damages resulting from injury to life, body or health.

11.2 For slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable damages typical at contract conclusion.

11.3 In any case, liability is limited to the value of the delivered goods where legally permissible.


12. Customer Registration

12.1 Customers may register free of charge in the online shop and create a permanent account. Registration is optional and does not guarantee entitlement.

12.2 A valid email address and password are required. The email serves as username and communication channel.

12.3 Customers confirm that all information provided is accurate and complete. Pseudonyms and multiple registrations are not permitted.

12.4 Login data must be kept confidential. Any suspected misuse must be reported immediately.

12.5 Customers are responsible for updating personal data in their account.

12.6 Registration may be deleted at any time upon request. Customer data will be irrevocably deleted unless legal retention obligations apply.

12.7 The Company reserves the right to discontinue customer accounts at any time. Affected customers will be informed and accounts permanently deleted.
